Terms of Service

By accessing or using the Fahra Realty Group platform (the "Platform"), including our website, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Services.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Your continued use after such notice constitutes acceptance of the updated Terms.

2.1 Eligibility

You must be at least 18 years of age to use the Services. By using our Platform, you represent that you meet this requirement and have the legal capacity to enter into a binding agreement.

2.2 Account Creation

To access certain features, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

2.3 Account Roles

The Platform offers three user roles: (a) User — can browse listings, save properties, schedule tours, and make reservations; (b) Broker — a licensed real estate professional who can create and manage property listings; and (c) Admin — a Fahra staff member with elevated privileges. Brokers must maintain a valid real estate license in their operating jurisdiction.

3.1 Permitted Use

You may use the Services for lawful purposes only and in accordance with these Terms. You may browse listings, contact brokers, schedule tours, save properties, and use other features as available to your account role.

3.2 Prohibited Conduct

You agree not to: (a) use the Platform for any unlawful purpose; (b) submit false or misleading information; (c) impersonate any person or entity; (d) scrape or systematically extract data without written permission; (e) attempt unauthorized access to the Platform or its infrastructure; (f) interfere with the performance of the Services; (g) post spam or unsolicited content; (h) engage in discriminatory practices in connection with property transactions; (i) use the Platform to facilitate financial crimes.

3.3 Broker Listing Standards

Brokers are solely responsible for the accuracy, completeness, and legality of their listings. Listings must comply with fair housing laws and accurately represent the property. Fahra reserves the right to remove any listing that violates our policies.

4.1 Subscription Plans

Certain features require a paid subscription. All prices are in US Dollars unless otherwise stated. Prices may change with 30 days' prior notice.

4.2 Billing and Renewal

Subscriptions are billed on a recurring basis. Your subscription will automatically renew unless you cancel before the renewal date. By providing a payment method, you authorize us to charge the applicable fees on each renewal date.

4.3 Cancellations and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for unused portions, except as required by applicable law.

4.4 Reservation Payments

Property reservations made through the Platform may involve payment processing through Stripe. By completing a reservation, you agree to Stripe's Terms of Service in addition to these Terms.

5.1 Platform as Information Service

Fahra Realty Group is an online platform that connects buyers, renters, and brokers. We are NOT a licensed real estate broker or agent, and we do NOT provide real estate, legal, or financial advice. All transactions are between users and the individual brokers or property owners listed on the Platform.

5.2 No Warranty on Listings

We do not verify, endorse, or guarantee the accuracy of any property listing, broker representation, or market information. All listing content is provided by third-party brokers. You should independently verify all property information.

5.3 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

5.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FAHRA REALTY GROUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNTS YOU PAID US IN THE PAST TWELVE MONTHS.

6.1 Our Content

The Platform, including its design, text, graphics, logos, and software, is owned by Fahra Realty Group or its licensors and is protected by applicable intellectual property laws.

6.2 Your Content

You retain ownership of any content you submit to the Platform. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and improving the Services.

7.1 Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.

7.2 Informal Resolution

Before filing any formal legal claim, you agree to attempt to resolve any dispute informally by contacting us at legal@fahra.co. We will attempt resolution within 30 days.

7.3 Binding Arbitration

If we cannot resolve a dispute informally, any claim shall be finally resolved by binding arbitration under the rules of the American Arbitration Association in New York, NY. You waive any right to a jury trial or class action.

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason including violation of these Terms, fraudulent activity, or non-payment. Upon termination, your right to use the Services immediately ceases.

Fahra Realty Group is committed to compliance with all federal, state, and local fair housing laws. We do not discriminate based on race, color, religion, national origin, sex, disability, familial status, sexual orientation, gender identity, or any other characteristic protected by applicable law. All brokers and users are required to comply with applicable fair housing laws.
